Re:    Violation of Master Space Agreement


It has come to our attention that in the early morning of 13 September 2002, officers Scott Gustafson and Yolanda Smith from the UCSD police department let themselves unannounced into the Ché Café, in blatant violation of the Master Space Agreement.

According to section 5.08 of the MSA, “…keys are provided solely to University Center Maintenance and the UCSD Police Department, to be used for necessary maintenance repairs (notice per section 5.05 of this agreement) and emergency access only...” Section 5.05 delineates the procedure for giving notice, stating “ when inspection is necessary during non-posted operating hours, a twenty-four (24) hour notice shall be given…”

The officers said that they suspected that someone had broken into the building to sleep, but that does not constitute an emergency, which is defined in section 5.08 as “a situation in which human life or property is in clear and immediate jeopardy and prompt summoning of aid is essential. Seeking to enforce compliance with UCSD Policies and Procedures shall not constitute an emergency” (emphasis added).  Furthermore, had someone broken into the Ché Café facility, the alarm company would have notified collective members, who would have dealt with the situation.

According to Section XIII.A. of the Memorandum of Understanding, “in the event of disputes arising between Co-op(s) and UCSD Administration, the AS and GSA Oversight Committee shall attempt informal resolution of the dispute prior to the initiation of formal grievance procedures.  Resolution shall be in a timely manner, not to exceed 30 days, unless extended by all parties.”  We expect your fullest cooperation in the informal resolution process.
