Dear xxxxxxx,
I regret to inform you that The Groundwork Books registered student organization has been identified in connection witn an incident of alleged misconduct at UCSD. A copy of a document entitled "Essential Information" is enclosed for your information. The entire UCSD Student Conduct Code is available on line at
http://ugr8.ucsd.edu/judicial/tblcontx.html for your review. However, the following is a brief description of the procedures for processing a complaint of alleged misconduct. You may also contact the UCSD Student Legal Services at (858) 534-4374 for legal advice and assistance with this matter.
Most allegations like this are resolved informally, through discussion with the Dean or a Dean's designee. However, if the allegations are not resolved informally, they may be referred to a formal hearing before a hearing body or a hearing officer. The Dean or Dean's designee will determine the sanction(s) to be imposed should you accept responsibility for the alleged misconduct or if you are found guilty upon the conclusion of a formal hearing. You may appeal the decision resulting from the formal hearing or the sanctions imposed by the Dean or designee.
Based on the information recieved as of the date of this letter, there is sufficient cause to believe that The Groundwork Books organization has violated the UCSD Student Conduct Code as follows:
Summary of Alleged Misconduct: It is alleged that Groundwork Books is hosting a website of the Kurdistan Workers Party (PKK), an organization listed by the U.S. Department of State as a Designated Foreign Terrorist Organization. Providing material support to a Designated Foreign Terrorist Organization is a violation of federal law and UCSD Policies.
Date of Incident:On or about April 5th, 2002 and beyond.
Location of Incident:UCSD Groundwork Books
Grounds for Discipline:Based on the information above, it is alleged that Groundwork Books has violated one or more of the items in the UCSD Student Conduct Code Section 22.14.10 as indicated in the summarized listing below:
Section 22.14.10.14. ...abuse of UCSD/University computing facilities...including but not limited to any violation of the Academic Computing Services (ACS) acceptable use policy.
To resolve this complaint you must contact Lynne Peterson, Acting-Assistant Vice Chancellor Student Programs within ten (10) academic days from the date of this letter to schedule a meeting to explore informal resolution of this matter. Although you are not required to make any statements or to disclose any information, any evidence that you feel is relevant or which may demonstrate that Groundwork Books was not involved in the alleged misconduct will be accepted and considered. Ms. Peterson's office may be reached by calling (858)534-4092.
